LeBeau Thelen has broad experience assisting clients in managing environmental issues that impact their businesses under laws governing air pollution, clean water, hazardous waste, pesticides and Proposition 65. We represent public and private clients in compliance and litigation under the California Environmental Quality Act (better known as CEQA). Our services include defending businesses and their owners in agency enforcement proceedings brought by USEPA, the state Department of Toxic Substances Control, the Central and Southern California Regional Water Quality Control Board and the San Joaquin Valley Unified Air Pollution Control District, among others. We litigate cases arising under or affected by state and federal Superfund laws, hazardous waste laws, safe drinking water laws and CEQA. Our expertise includes:
- Representing public agencies in preparing, challenging or defending environmental impact reports and negative declarations under CEQA
- Litigation between private parties regarding environmental contracts and covenants and noncontractual claims for nuisance or trespass resulting from the release or migration of hazardous substances
- Defense of malpractice claims brought against environmental consultants
- Negotiating and resolving agency claims against our business clients for civil penalties
- Defending claims brought against our business clients for response costs under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA)
